Robbins Firm Secures Victory for Large Family Trust In Divorce Action

The Robbins Firm represented a large family trust which had been brought into a divorce action and alleged to have been participating in a fraudulent transfer.  The dispute involved complex issues of corporate and tax law, estate planning, and fraudulent transfer law.  We were able to prevail on summary judgment on all claims against the trust.  The Court ruled as matter of law that there was no evidence of fraudulent intent or other “badges of a fraudulent transfer, including insolvency or inadequacy of consideration.  The case is significant because family trusts and businesses are frequently embroiled in high net worth divorce cases often involve, creating additional expense and complexity.  The Robbins Firm has represented numerous businesses and trusts in divorce actions recently and have been successfully in avoiding any liability of these entities.
