Firm Secures Dismissal of All Claims in Title Action

The Firm recently obtained a dismissal of all claims brought against our client, a FinTech company in the alternative lending industry, in a Fulton County Superior Court matter. The Plaintiff, another lending company, brought an action to quiet title to land upon which both parties held security deeds and for declaratory judgment related to certain underlying contracts. We moved to dismiss the claims against our client under Rule 12(b)(6), arguing that our client’s prior cancellation of its security deed extinguished any purported cloud on the title to the property and any other potential harm to the Plaintiff. The Court agreed and entered an order summarily dismissing all claims against our client.
