We represented an individual defendant and two corporate defendants in a partnership dispute regarding a real estate transaction pursuant to which the plaintiff was seeking over $2.1 million in damages, plus punitive damages. The Superior Court granted our motion to dismiss for failure to state a claim as to the following claims asserted by plaintiff: (1) Georgia RICO, (2) conversion, (3) breach of fiduciary duty, (4) fraud, (5) unjust enrichment, and (6) constructive trust.
